What is the Problem
Under the Local Government (Miscellaneous Provisions) Act 1976, a person authorised in writing in that behalf by a local authority may at any reasonable time. Survey any land in connection with a proposal by the authority to acquire compulsorily an interest in the land..” Other than Local Authorities, acquiring authorities don’t have powers of entry for survey prior to Secretary of State confirming compulsory purchase powers for a scheme.

Aim
It is therefore proposed that
• S11(3) CPA 1965 is amended to grant this same right to all statutory bodies and utility companies
Keep the same notice periods and right to compensation for any damage currently in S11(3) CPA 1965
