Welsh CPO Draft Circular and Best Practice:
a consultation and engagement event
The Welsh CPO Circular has now been in place for fifteen years. The Welsh Government has released a draft Circular for consultation, along with a revised national planning policy on the use of compulsory purchase powers for Wales. The consultation has been published today on Annex A: DRAFT Circular 003/2019 Compulsory Purchase in Wales and ‘The Crichel Down Rules (Wales Version, 2019)’. Click here for details.
It is important for those involved in the CPO process to be aware and to comment on the updated draft Circular and provide views on the proposed policy approach. These two briefing and engaging events are an ideal way to get up to speed. Andrew Ward, from the Welsh Government’s Planning Directorate, will explain the key provisions of the consultation document, answer your questions and is keen to hear your views.
With compulsory acquisition being promoted as a positive tool in delivering development and regeneration in Wales, the session will also provide an opportunity to look at the differences between the Welsh and English systems and to learn about potential pitfalls and areas of best practice.

The current NPPF was published in February 2019 - seven years after the original document and only seven months after the 2018 update. It is the third version and aims to improve the clarity of national policy, as well as addressing key issues in relation to the delivery of housing and economic growth.
The changes introduced earlier this year follow the Government’s technical consultation in late 2018. As part of this update, Government has provided:
- clarification on the application of the Housing Delivery Test,
- updated and reissued guidance in relation to the carrying out of housing and economic needs assessments,
- recast the definition of a ‘deliverable’ site, and
- clarified that the presumption in favour of sustainable development will not apply where there are effects on a habitats site (unless an appropriate assessment concludes that negative impacts will not occur).
It could be said that the 2018 and 2019 iterations of the NPPF demonstrate that the Government is applying a new approach to application of national planning policy and guidance. This roadshow will bring together lawyers, solicitors, planners, surveyors and viability specialists to understand the mechanics of the 2018 and 2019 reboots of the NPPF and how this is playing out in practice?
